JUSTICE PARTHA SARTHY ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 12-12-2022 Petitioner has prayed for the following relief(s):- "(a) Issuance of writ in the nature of certiorari to quash the letter dated 27.07.2019 and consequent letter dated 26.08.2019 where by the candidature of the petitioner for R.O. dealership at location between Belganchi Bazar chowk and Hareramapur Chowk on N.H.-31 on Purnea Baisi Road (RHS) Purnea towards Siliguri district Purnea under open category as candidature is not valid for considering offered land under group-I, however the candidature at the petitioner may get considered for selection with

(b) Issuance of writ in the nature of Mandamus commanding the respondents to consider the candidature of the petitioner as valid as per the norms guidelines of the Indian Oil Corporation Ltd. (in short IOCL) and granting twenty one days time for submitting the documents relating to the land which has been produced by the petitioner as new as suggested by your officer whereas the same documents was prepared prior to the filing of the instant application if required.

(c) The respondents further be directed to grant licence for dealership concerned as his fate favoured him and in lottery he got position first but due to some misunderstanding after submission of relevant documents within prescribed period he placed in group-III be placed group-I after giving twenty one days time for producing old prepared documents. (d) To grant any other relief/ reliefs for which the petitioner is entitled too."

After the matter was heard for some time, learned counsel for the petitioner, under instructions, seeks permission to withdraw the present petition reserving liberty to file a fresh petition, on the same and subsequent cause of action, furnishing better particulars and additional materials, if so required and desired.

Permission granted with liberty as prayed for. As and when any such petition is filed, the same
