The petitioner has prayed for bail in a case registered for the offence punishable under sections 25(1-b)A/26/35 of the Arms Act.

As per allegation in the FIR, when the police party was on patrolling and found the accused persons including the petitioner roaming on road side in suspicion condition, police chased them and all three were apprehended. On search, one loaded country made katta, one live cartridge and one mobile from possession of this petitioner. And several arms were also recovered from rest of the two accused persons. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case due to

Patna High Court CR. MISC. No.70314 of 2022(2) dt.20-03-2023 2/2 local village politics. Police took signature of the petitioner on plain paper by applying force and later on, they have converted it into seizure list. Petitioner is languishing in judicial custody since 12.07.2022.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned CJM, Vaishali at Hajipur in connection with Hajipur Town P.S. Case No. 521 of 2022.
