JUSTICE PURNENDU SINGH ORAL JUDGMENT Date : 11-07-2023 Heard Mr. Ashok Kumar Sinha, learned counsel along with Mr. Shyam Sunder Pandey, learned counsel appearing on behalf of the petitioner and Mr. Anuj Kumar, learned AC to GP-24 for the State.

2. Let the hard copy of the counter affidavit filed on behalf of the respondent no.6 be kept on the record.

3. Learned counsel appearing on behalf of the petitioner informs this Court that the respondents have admitted in Para-5, 6 and 10 of the counter affidavit that payments of retiral dues admissible to the petitioner have been made. Para-5.

Patna High Court CWJC No.17302 of 2022 dt.11-07-2023 2/3 6 and 10 of the counter affidavit are reproduced hereunder: "5. That it is respectfully and humbly submitted that the authority letter from GPF office Bhagalpur was received in Circle Office, Chandan on dated 05/07/2023 authorizing as sum of rupees 3,69,570/- (Three Lakh Sisty Nine Thousands Five Hundred Seventy Rupees Only) with interest calculated thereon upto 31/05/2023.

That it is pertinent to mention here that all the sanctioned amount of G.P.F. with interest calculated thereon upto 31/05/2023 for rupees Rs. 3,69,570/- (Three Lakh Sixty Nine Thousands Five Hundred Seventy Rupees Only) was passed by the treasury vide treasury voucher No. PBNK230780090000007 dt. 06/07/2023.

10. That with regard to the statement made in paragraph no. 5 of the writ petition it is respectfully submitted that G.P.F. amount of Rs. 3,69,570/- (Three Lakh Sixty Nine Thousands Five Hundred Seventy Rupees only) has credited to the Account No.11886194074 of the petitioner on dated 06/07/2023."

4. Learned counsel appearing on behalf of the petitioner submits that with respect to the difference on the basis of the calculation made on different heads of retiral dues and interest on account of delayed payment, the petitioner wants to file a detailed representation.

5. Considering the aforesaid fact and the submission made on behalf of the petitioner, if so advised, the petitioner may file a detailed representation before the concerned authority who will dispose of the representation of the petitioner and will ensure the payment of other remaining dues on account of retiral dues with up-to-date interest till date of payment is made within 6 weeks from the date of the filing of

6. With the above observation and direction, the writ application stands disposed of.
