JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-10-2019 This is an application for grant of anticipatory bail in connection with Complaint Case No. 158 of 2019, disclosing offences under Sections 420, 406, 34 of IPC. As per complaint case allegation has been made against the petitioner that there was an agreement for sale of 10 acres of land, for which, Rs. 70 lacs has been given in advance, but later on, complaint came to know that with respect to the said land, a case is pending before the Sub Judge, of which, he asked the petitioner to return the amount, but he is not returning the same, as such, the complainant has been cheated by the petitioner.

Submission of the learned counsel for the petitioner is

Patna High Court CR. MISC. No.64847 of 2019(2) dt.17-10-2019 2/2 that the there is no chit of paper to show that the amount of Rs.70 lacs has been received by the petitioner in advance for the sale of land.

Heard learned A.P.P. as well as learned counsel for the complainant, who has opposed the prayer for anticipatory bail on the ground that Annexure 3 itself shows that payment was made and there is signature of the petitioner over the same. Having heard both sides, in view of the allegations, I am not inclined to grant privilege of anticipatory bail to the petitioner. However, he may surrender before the learned court below and make prayer for regular bail.
