JUSTICE SUDHIR SINGH ORAL ORDER 23-05-2017 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are languishing in custody since 16.03.2017 in connection with Barhara (Khawaspur O.P.) P.S. Case No. 72/2017, corresponding to Excise Case No. 25/2017 for the offences instituted under Sections 30(A)/56 of the Bihar Excise Amendment Act, 2016.

The prosecution story, in brief, is that the police caught the petitioners while they were carrying 96 liters of foreign liquor in the Tempo.

It has been submitted on behalf of the petitioners that the petitioners are in custody since 16.03.2017. There is no allegation

Patna High Court Cr.Misc. No.23304 of 2017 (2) dt.23-05-2017 2/2 of tampering of the witnesses alleged against the petitioners. They have got no criminal antecedent. It is alleged that 96 liters of foreign liquor is said to have been recovered from the back of the Tempo. The petitioners have no concern with the said seized liquor. No compliance of Section 100 Cr. P.C. has been made in the present case.

On behalf of the State, it has been submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge, Ara, in connection with Barhara (Khawaspur O.P.) P.S. Case No. 72/2017, corresponding to Excise Case No. 25/2017.
