JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 31-08-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Bidupur P.S. Case No. 340 of 2014 registered under Sections 147, 148, 149, 341, 323, 354, 379, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act.

The accusation is that cow of co-villager Naresh Singh fallen into the well of the informant and thereafter, petitioner along with 8-9 un-known persons armed with weapons came at the door of the informant and started abusing and assaulting on the pretext of non-filling up the well. Petitioner Naresh Singh fired upon the informant which do not hit him and when his old mother Chandrawati Devi came for rescue, petitioner assaulted her on left side of forehead with the butt of his pistol resulting she fell down and then un-known persons assaulted her on left hand causing injury and petitioner also snatched his golden chain worth Rs.

Patna High Court Cr.Misc. No.22822 of 2017 (4) dt.31-08-2017 60,000/- Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case due to dirty village politics. There was a petty dispute of downfall of the cow of the petitioner into the well of the informant. He further submits that there is lacerated wound of 3" X 2 1⁄2" near the left side of cheek bone below and left side of eye and opinion about the nature of injury is kept reserve. Petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Bidupur P.S. Case No. 340 of 2014 subject to the condition as laid down under Section 438(2) of the Cr.P.C.
