JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-01-2020 This is an application for grant of anticipatory bail in connection with Bandhukurawa P.S. Case No. 17 of 2017 disclosing offence under Sections 366(A), 365 and 34 of the Indian Penal Code.
There is allegation of kidnapping one minor daughter of the informant Sabita Kumari and against other co-accused is kidnapping of other minor daughter of the informant. Submission of the learned counsel for the petitioner is that after marriage with Sabita Kumari, they are residing together and the girl in her statement under Section 164 Cr.P.C., discloses her age as 18 years.
Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail.
Though there is allegation of kidnapping of minor
Patna High Court CR. MISC. No.70372 of 2019(2) dt.16-01-2020 2/2 daughter of the informant and considering the fact that both are residing together as per her statement recorded under Section 164 of Cr.P.C., this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Additional Chief Judicial Magistrate-III Banka, in connection with Bandhuwakurawa P.S.
