The petitioner seeks bail in P.S. Case No. 135 of 2017 instituted for the offence under Section(s) 37 (b) of the Bihar Prohibition and Excise Act, 2016.

There is an allegation against the petitioner that he was found in drunken state. The Breath Analyzer Test was conducted and the report was found 57.5 ml. of alcohol in 100 ml. It is submitted that the petitioner has no criminal antecedent. He is said to be in custody since 02.04.2017. In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed.

Let the petitioner, above named, be released on bail

Patna High Court Cr.Misc. No.24202 of 2017 (2) dt.22-05-2017 2/2 on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of like amount each to the satisfaction of 4th A.D.J.-cumSpecial Judge, Excise Act, Bhagalpur in connection with P.S. Case No. 135 of 2017, subject to the condition that both the bailors shall be the close relative of the petitioner.
