Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 13.7.29018 passed in Cr. Misc. No.22535 of 2017 and the petitioner is said to be conspirator in causing death of the deceased. Submission of the learned counsel for the petitioner is that except suspicion there is nothing against the petitioner and one of the co-accused has been granted bail by this Court, vide order dated 5.9.2018 passe din Cr. Misc. No.53215 of 2018. The petitioner is in custody for more than two years. Heard learned A.P.P. and the learned counsel for the informant. They have opposed the prayer for bail. Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named,
Patna High Court Cr.Misc. No.71012 of 2018(2) dt.12-12-2018 2/2 be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned 9th Additional Sessions Judge, Muzaffarpur in connection with Sakra P.S.Case nO.260 of 2016 dated 21.9.2016 (G.R.No.3920 of 2016) with condition that he has to co-operate in disposal of the trial and appear as and when required otherwise his bail bond shall be cancelled. With the aforesaid observation, this application is allowed.
