The petitioners seek bail in connection with Mairwa P.S. Case No. 209 of 2019 (G.R. No. 03 of 2019), registered for the offence punishable under Sections 20, 22, 25 and 27 of the NDPS Act.
Learned counsel appearing on behalf of the petitioners submits that the petitioners are innocent and have falsely been implicated in the present case. Further submission is that nothing has been recovered from the conscious possession of the petitioners. He further submits that from perusal of FIR, it appears that on interrogation regarding recovered Ganja,
Patna High Court CR. MISC. No.64636 of 2019(2) dt.08-11-2019 2/2 petitioners told that Sanjay Upadhyay and Raju Upadhyay both are businessmen of Ganja and they were came there for purchasing half kilogram Ganja. He further submits that from perusal of the seizure list, it appears that the recovery has been made from the house of Sanjay Upadhyay. The petitioners have no criminal antecedent and in custody since 08.08.2019. Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the above-named petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Siwan in connection with Mairwa P.S. Case No. 209 of 2019 (G.R. No. 03 of 2019).
