The petitioners seek bail in Jehanabad P.S. Case No. 451 of 2018 instituted for the offence under Sections 302 and 379/34 of the Indian Penal Code.

Counsel for the petitioners submits that there is no allegation of any specific overt act against the petitioners. In the written report it is alleged that altercation took place between mother of informant and Nago Yadav on the issue of she buffalo. Thereafter, Nago Yadav and petitioners assaulted mother of the informant. It is further alleged that Nago Yadav pushed mother of the informant, on account of which, she fell down in the ditch and sustained serious internal

Patna High Court Cr.Misc. No.69934 of 2018(2) dt.03-12-2018 2/2 injuries. The mother of informant was taken to Hospital where she died during course of treatment.

In this manner, there is no allegation of any specific overt act against the petitioners.

Petitioners are said to be in custody since 23.8.2018. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioners above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad, in connection with Jehanabad P.S. Case No. 451 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioners. (Sanjay Priya, J) S.Ali/- U T
