Petitioner apprehends arrest in a case registered for the offences punishable under Sections 379, 411 of Indian Penal Code, Sections 56(1), 56(ii) of the Bihar Minor Mineral Concession Rules, 1972 and Sections 33, 41, 42, 52, 52(iii) of the Forest Act.

As per prosecution case, one truck was seized loaded with stone boulders.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. It is submitted that petitioner is not the owner of truck in question and has got no concern with the illegal mining of stones. Petitioner claims clean antecedent.

No.69074 of 2022(2) dt.21-03-2023 2/2 Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sasaram, Rohtas in Sasaram (M) P. S. Case No. 71 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
