JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 15-02-2018 Heard the learned counsel for the petitioner and the learned counsel appearing for the State.
In the counter affidavit filed on 29.01.2018 statement has been made in paragraph 8 of the counter affidavit that all the persons, including the petitioner, will be paid their salary within a period of one month after completing all the necessary formalities. Paragraph 8 of the counter affidavit is as follows : "8 : That in view of the matter all these petitioners will be paid within a period of one months after
Patna High Court CWJC No.7608 of 2017 (2) dt.15-02-2018 2/2 completing all necessary formalities."
In view of the specific undertaking in paragraph 8 of the counter affidavit, filed on 29.01.2018, the writ application is disposed of.
The Court hopes that the respondent will abide by their undertaking, contained in paragraph 8 of the counter affidavit, filed on 29.01.2018 and ensure payment to the petitioner within the time indicated in the counter affidavit. In case, on receipt of the payment the petitioner feels that he is entitled to any other monetary relief, he shall be at liberty to raise the grievance by way of filing representation before the respondent-authority, who shall look into the grievance and pass appropriate reasoned and speaking order within a period of filing of such representation.
