The petitioner seeks bail in Shahkund P.S. Case No. 195 of 2017 instituted for the offence under Sections 341, 384, and 307 of the Indian Penal Code, Sections 25(1-b)a, 26 and 27 of the Arms Act, but charge sheet has been submitted under Sections 341, 385 and 387 of the Indian Penal Code. Counsel for the petitioner submits that petitioner is in custody since 26.8.2017.
In the written report there is allegation that petitioner made firing on the informant but it did not hit him, but it hit on the Mobile which was kept in the pocket of the informant on account of which the Mobile of the informant got damaged. He
Patna High Court Cr.Misc. No.69948 of 2018(2) dt.03-12-2018 2/2 has sustained injuries on his stomach.
The injury report of the informant has been enclosed as Annexure-3 whererin the Doctor has found all the injuries on the person of the informant to be simple in nature. Counsel for the informant has appeared and opposed prayer for bail.
Petitioner is said to be in custody 26.8.2017. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 7th Additional District & Sessions Judge, Bhagalpur, in connection with Shahkund P.S.
