2. In this case, the petitioner is seeking regular bail in connection with Manpur P.S. Case No. 79 of 2023, registered for the offences punishable under Sections 376, 379, 447, 448, 506 of the IPC.

3. As per allegation, when the informant was sleeping in her house along with her two children, the petitioner entered into her house and at the point of knife, he committed rape upon her. Thereafter, he fled away after taking Rs. 80,000/- from her house.

4. The learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.71642 of 2023(8) dt.13-08-2024 2/2 that the petitioner is innocent and has falsely been implicated in this case. He is a person of clean antecedent. The reason for his false implication is that the informant was dealing with business of illicit liquor and when the petitioner objected, he was falsely implicated in this case. He is under custody since 05.05.2023.

5. On the other hand, the learned counsel for the informant submits that both the parties have compromised the case.

Considering the above-mentioned facts and circumstances as well as period of custody and also the fact that after realizing the real fact, the informant has filed compromise petition, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Biharsharif, Nalanda in connection with Manpur P.S. Case No. 79 of 2023, subject to the following condition:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
