====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 18-10-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody in connection with Kotwa P.S. Case No. 121 of 2019 for the offenses under Section 394 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the instant case merely on the confessional statement of Raju Kumar. Learned counsel for the petitioner would submit that on the date of alleged occurrence, the petitioner was in jail custody and as such his involvement in the present case is false. The petitioner is in custody since 04.07.2019.

Considering the aforesaid, the Court is inclined to

Patna High Court CR. MISC. No.66024 of 2019(2) dt.18-10-2019 2/2 grant bail to the petitioner. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Kotwa P.S. Case No. 121 of 2019.
