2. Petitioner seeks regular bail in a case registered for the offence punishable under Sections 272 and 273 of the IPC and Section 30(a) of the Bihar Prohibition & Excise Act. 3 . As per the prosecution case , 60 litres of Nepali Desi liquor was recovered from an open place .

4. Learned counsel for the petitioner submits that no incriminating material has been recovered from conscious possession of the petitioner. Petitioner has been made accused in this only on the basis of suspicion . Petitioner is in custody since 06.09.2024 . Chargesheet has already been submitted. 5 . Learned A.P.P. for the State vehemently opposed the bail application .

6. Considering the nature of accusation and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge - Cum- Special Judge Production Act Jhanjharpur District Madhubani in connection with G.R. No. 267 / 2024 arising out of Rudrapur P. S. Case No. 34 of 2024 .
