03-12-2018 Heard Sri Akhauri Kamal Kishore Sahay, learned counsel for the petitioners and learned Addl. Public Prosecutor. Three petitioners, who are in custody in Sadar P.S. Case No. 688 of 2018 registered for offence under Sections 414, 401 of the Indian Penal Code and Sections 20, 22 of the Narcotic Drugs & Psychotropic Substances Act, 1985, have prayed for grant of bail.
At the very outset, learned counsel for the petitioners has drawn my attention to statement made in paragraph - 3 of the petition to show that petitioners are having clean antecedent. Learned counsel for the petitioners has also drawn my attention to seizure list, which is part of the F.I.R., to show that from
Patna High Court Cr.Misc. No.70714 of 2018(2) dt.03-12-2018 2/2 possession of petitioner no. 1, two sachet of ganja, from possession of petitioner no. 2, three sachet of ganja and from possession of petitioner no. 3, two mobile phones were recovered. It has been reiterated that recovered ganja was of small quantity and it was not for commercial use. Considering the fact that the recovered ganja was of small quantity and petitioners are having clean antecedent, let aforesaid three petitioners namely 1. Akhilesh Kumar, 2. Ravi Raushan Kumar @ Ravi Bhushan Kumar and 3. Bhola Kumar @ Md. Shamim be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cumSpecial Judge, Muzaffarpur in connection with Sadar P.S. Case No. 688 of 2018.
