The petitioner seeks bail in connection with Amarpur P.S. Case No.348 of 2019 registered under Section 392 of the Indian Penal Code.

The accusation is that the informant Rahul along with Sanjay Kumar Yadav was coming to his house boarding on the motorcycle in the evening of 17.07.2019. When they reached near Bharna Forest, then they saw four persons with two motorcycles. Thereafter, two persons, who were on Pulser Motorcycle having no registration number, pushed the motorcycle of the informant. In the meantime, two persons, who were on another motorcycle, reached there and all the four

No.73369 of 2019(4) dt.06-03-2020 2/2 persons, pointing the pistol at him, took gold chain, ring, cash Rs.3200/- ATM Cards and mobile of the informant and also snatched the mobile set and motorcycle of Sanjay Kumar Yadav. At that time, the informant identified Sagar Kumar alias Niso (petitioner) and Rinku Kumar, resident of neighbouring village of the informant.

Learned counsel appearing on behalf of the petitioner submits that the petitioner has no criminal antecedent and due to dirty village politics, his has falsely been implicated in this case. The petitioner is in custody since 19.07.2019. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Banka, in connection with Amarpur P.S. Case No.348 of 2019. Out of the two sureties, one must be either parents or the close relative of the petitioner.
