2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 386 and 34 of the Indian Penal Code.

3. The prosecution case in nutshell is that when the informant was sitting on roof top of his shop. Petitioner and other co-accused persons came and this petitioner demanded Rs. 3,00,000/- as extortion by putting pistol over the chest of the informant. It is further alleged that co-accused also pointed pistol over the informant and due to fear, the gave Rs. 10,000/- as extortion.

4. Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.72177 of 2023(3) dt.19-12-2023 2/2 petitioner is innocent and has committed no offence. He has falsely been implicated in this case. The demand of extortion money has not been executed. Only on the basis of long existing rivalry related to agricultural land between the informant and the petitioner, he has been dragged in this case. Similarly situated other co-accused person has already been granted bail by this Court vide order dated 05.04.2023 in Cr. Misc. No. 4080 of 2023. Moreover, the petitioner is languishing in judicial custody since 18.06.2022.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Nowkothi P.S. Case No. 63 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai.
