JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-01-2020 The petitioner seeks regular bail in connection with Jadiya P.S. Case No. 128 of 2019, registered for offences punishable under Sections 326, 307 and 34 of the Indian Penal Code and Section 27 of the Arms Act.

Prosecution case is that father of the informant informant his father that some miscreants have fired on his Fufa, on which, father of the informant went there and took the injured to hospital. F.I.R. was registered against unknown. Later on the statement of the injured as well as one Suresh Yadav was recorded, in which, the name of petitioner surfaced. It has been submitted on behalf of the petitioner that petitioner is not named in the F.I.R. though there is delay in lodging the F.I.R. Later on he has been made accused in this

Patna High Court CR. MISC. No.63984 of 2019(3) dt.09-01-2020 2/2 case due to enmity. Moreover, petitioner has been in custody since 25.07.2019.

Having heard both sides, in view of the above submission, this application is allowed. Let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul, in connection with Jadiya P.S. Case No. 128 of 2019, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
