JUSTICE SHIVAJI PANDEY ORAL ORDER 13-07-2017 Heard learned counsel for the petitioner and learned counsel for the State.

In this case, the petitioner is seeking anticipatory bail in connection with Sheohar P.S. Case No.158 of 2014, registered for the offence punishable under Sections 307/34 of the Indian Penal Code and under Section 27 of the Arms Act. As per the allegation, three persons including the petitioner came in a motor-cycle and the person who was sitting in the middle, fired towards the informant, but he laid down his body to save his life and thereafter they fled away. The reason behind the occurrence has been stated that some miscreants had demanded Rs.5 lakh as ransom from his brother, but he refused.

Patna High Court Cr.Misc. No.28267 of 2017 (3) dt.13-07-2017 The petitioner has criminal history, but learned counsel for the petitioner tried his best to explain that in two cases he has been acquitted and one case has been lodged by his brother.

Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected. If the petitioner surrenders before the Court below within four weeks from today and prays for bail, the Court below will pass the order in accordance with law without being influenced by the order of this Court.
