The petitioner seeks regular bail in Katihar Nagar Sahayak P.S. Case No. 709/2018, registered for the offences punishable under Sections 192, 193, 211, 406, 420, 419, 471 and 120(B) of the Indian Penal Code.

It is alleged by the Officer Incharge Nagar P.S. Katihar that for recovery of kidnapped person namely, Rahbar Alam (petitioner) of Nagar Sahayak P.S. Case No. 699/2018 informant was helping the I.O. in investigation and recovery of the victim. The informant during that period got information that ransom amount has been demanded from the family members of the accused Rahbar Alam, to free him.

No.74436 of 2018(2) dt.12-12-2018 2/2 The police during investigation found that this petitioner has himself made telephone call to his family members to make payment of Rs. 8,00,000/- as ransom after hatching story of his kidnapping just to repay the amount of Rs. 8,00,000/- which he has taken as loan from different person. The police thereafter arrested this petitioner and filed the instant case.

As such from written report it appears that petitioner has hatched story of his kidnapping for reason to collect money from his family members to repay the loan amount. The petitioner is in custody since 28.09.2018.

Therefore considering the period spent by petitioner in custody, prayer of the petitioner for grant of bail is allowed. Let the petitioner above-named, be released on bail on furnishing bail bond of Rs. 10,000 (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar in connection with Katihar Nagar Sahayak P.S. Case No. 709/2018, subject to the condition that both the bailors will be close relative of petitioner. (Sanjay Priya, J) vinita/- U T
