NILU AGRAWAL ORAL ORDER 21-06-2017 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is languishing in jail since 26.03.2017 in a case registered for offences punishable under Sections 272, 273 and 290 of the Indian Penal Code and under Sections 30 (A) and 30 (B) of Bihar Prohibition Excise Act, 2016. The prosecution case as lodged by the police personnel is that on patrolling duty, they found one person in a drunken condition and on search of his house, 20 liters country made Mahua wine were recovered from the corner of the house and accordingly, the seizure list was prepared.

It has been submitted by the learned counsel for the petitioner that he is innocent and the said house is a joint family

He submits that nothing has been recovered from his conscious possession and that he has no criminal antecedent. Learned A.P.P. for the State however, opposes the prayer for bail.

Considering the facts and circumstance and materials on record, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each the to the satisfaction of learned Additional Sessions Judge-II Cum Special Judge, Katihar in connection with Kursela P.S.Case No. 37 of 2017.
