The petitioner is languishing in custody since 8.8.2019 in a case registered for the offences punishable under Sections 307,324, 379/34 and 411 of the I.P.C. and Section 27 of the Arms Act.
The prosecution case is that the informant sold a precious stone of Neelam worth Rupees Fourteen Lacs to the petitioner in October, 2018 but no payment was made against the said stone. On demand being made, the petitioner ordered his bodyguard to shoot at the informant, as a result he fired causing injury to the informant.
It is submitted by learned counsel for the petitioner that it appears unreasonable that a stone worth Rupees Fourteen Lacs was sold to the petitioner. It is further submitted that the

No.62408 of 2019(2) dt.22-10-2019 2/2 accusation of firing is against the bodyguard of the petitioner, who has been granted bail vide order dated 4.9.2019 passed in Bail Petition No. 1495 of 2019 by the learned Sessions Judge, Patna. Though the petitioner is accused in four other cases but they have been lodged at the behest of Junior Engineer against whom he had preferred PIL.
Learned counsel for the informant submits that on the order of the petitioner, firing was made by his bodyguard. Considering the thrust of accusation against the bodyguard who has already been granted bail and the period in custody, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Patna in connection with Pirbahore P.S. Case No. 416 of 2019.
