====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 03-12-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Bye-Pass P.S. Case No. 279 of 2018 instituted for the offence under Sections 379, 411, 413 and 414 of the Indian Penal Code.

Counsel for the petitioner submits that alleged recovery of Motorcycle is not made from conscious possession of the petitioner. The seizure list has been prepared which is part of the First Information Report. From seizure list it appears that alleged Motorcycle has been recovered from ByePass four lane in front of Moti Dhaba, Dhawalpur. Petitioner is said to be in custody since 7.9.2018 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the

No.69992 of 2018(2) dt.03-12-2018 2/2 petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Smt. Rashmi Prasad, learned Additional Chief Judicial Magistrate-Ivth, Patna City, in connection with Bye-Pass P.S. Case No. 279 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
