The petitioner seeks bail in connection with Amarpur P.S. Case No. 125 of 2019, registered under Sections 363, 366A and 34 of the Indian Penal Code.

The accusation is that daughter of the informant, Gauri Devi, moved from village with the petitioner for fair, but, she did not return. The informant raised suspicion about kidnapping of her daughter by the petitioner and other family members.

Submission is that in fact due to love affairs daughter of the informant left the house and reached Delhi with the petitioner and performed marriage in temple. The statement of the victim daughter of the informant was recorded under Section 164 of the Criminal Procedure Code on 01.06.2019 in which she

Patna High Court CR. MISC. No.72362 of 2019(2) dt.11-12-2019 2/2 has stated about performing marriage with the petitioner according her sweet-will. At that time, her age was also assessed about 17 years. Further, submission is that the petitioner is in custody since 02.06.2019.

Having regard to the facts and circumstances of the case, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Amarpur P.S. Case No. 125 of 2019 to the satisfaction of the Chief Judicial Magistrate, Banka.
