JUSTICE ANIL KUMAR SINHA ORAL ORDER 23-10-2019 The petitioners apprehend their arrest in connection with Harhowrah P.S.Case No. 582 of 2019 registered under Sections 30 and 30(a) of the Bihar Prohibition and Excise Act. Allegation against the petitioner, as per FIR, is that the police, on secret information that the petitioner along with other co-accused persons were indulged in trade of illicit liquor, proceeded towards house of co-accused Pankaj Kumar @ Sanjay Mahto and recovered a total quantity of 840 litres of illicit liquor along with 210 litres of spirit from the cattle house of said Pankaj Kumar @ Sanjay Mahto.

Learned counsel for the petitioners submits that petitioners have falsely been dragged in this case merely on the basis of secret information allegedly received by the police. He

No.65101 of 2019(2) dt.23-10-2019 2/2 further submits that petitioners have got no criminal antecedents and no illicit liquor or spirit has been recovered from the conscious possession or from the houses or premises belonging to them Having regard to the submissions made by the parties and taking into consideration the fact that no recovery has been made from the possession of the petitioners or premises belonging to them and petitioners have got no criminal antecedents as such I am inclined to grant anticipatory bail to the petitioner.

Let the petitioners, abovenamed, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of the learned Xith Additional District and Sessions Judge, Saran at Chapra, in connection with Marhowrah P.S.Case No. 582 of 2019; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
