In this case, the petitioner is seeking regular bail in connection with Pirpainty (Bakharpur) P.S. Case No. 176 of 2022, registered for the offences punishable under Sections 364/120(B)/34 I.P.C.

As per allegation, co-accused Yogesh Yadav took away the brother of the informant at the pretext of watching fair. In the way, notorious criminals namely, Mohan Thakur, Suman Thakur, Sonu Kumar, Golu Kumar, Tiger Kumar, Dhiraj Kumar and Aman Tiwary kidnapped the brother of the informant with intention to kill.

The learned counsel for the petitioner has submitted that petitioner is not named in the FIR. He is a person of clean antecedent. He is under custody since 13.06.2022. The named

Patna High Court CR. MISC. No.71457 of 2022(2) dt.27-03-2023 2/2 accused Sonu Kumar has been granted bail by a coordinate Bench of this Court in Cr. Misc. no 48002 of 2022. Considering the above mentioned facts and circumstances as well as clean antecedent of the petitioner, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned XIV Additional Sessions Judge, Bhagalpur in connection with Pirpainty (Bakharpur) P.S. Case No. 176 of 2022, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

(ii) If the petitioner is found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioner and the learned court below will take decision in accordance with law.
