The petitioner seeks bail in Spl. (POCSO) Case No. 30/2018, arising out of Nardiganj P.S. Case No. 106/2018, instituted for offences under Section(s) 354(B) and 452 of the Indian Penal Code read with Section 8 of POCSO Act. Learned counsel for the petitioner has submitted that instant case is counter blast of Nardiganj P.S. Case No. 107/2018, filed by wife of this petitioner against father of informant and others in which this petitioner was brutally assaulted by informant's side. He was found in unconscious position and got treated in Sadar Hospital, Nawada. Thereafter he was referred to P.M.C.H. Injury report of petitioner is annexed as Annexure-3 and 3/1.

Patna High Court Cr.Misc. No.71177 of 2018(2) dt.05-12-2018 2/2 In the instant case, informant has alleged that this petitioner entered into her house and started touching her body. There is general and omnibus allegation against this petitioner.

Petitioner is in custody since 22.07.2018.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ADJ 1st -cum-Spl. Judge, Nawada in connection with Spl. (POCSO) Case No. 30/2018, arising out of Nardiganj P.S. Case No. 106/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
