The petitioner seeks bail in connection with Naya Ram Nagar (Safiasarai O.P) P.S. Case No. 285 of 2018, registered under Section 304(B)/34 of Indian Penal Code, pending in the Court of learned Addl. Chief Judicial Magistrate-I, Munger.

The accusation is of killing of the daughter of the informant by her husband and in-laws due to non-fulfillment of demand of dowry within two years of her marriage. Learned counsel appearing on behalf of the petitioner submits that petitioner is the husband of the deceased and he used to reside at Delhi for his livelihood. After the marriage, the deceased, wife of petitioner, started giving

No.67564 of 2019(3) dt.18-02-2020 2/2 pressure to the petitioner to take her along with her female child at Delhi, but due to poor earnings of the petitioner, he was not ready to take the deceased at Delhi due to that reason, she committed suicide by hanging herself with the ceiling fan. The witnesses, in paragraph Nos. 10, 11 and 12, have also stated that on knowing about committing suicide by the deceased, wife of petitioner, all reached there and found dead body of the deceased was hanging with the ceiling fan. Further submission is that petitioner is in custody since 11.07.2019. Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to enlarge the petitioner on bail. Accordingly, the prayer of the petitioner, above named, is rejected.
