The petitioner seeks bail in Kasba P.S. Case No.63 of 2016 registered for the offence punishable under Sections 457 and 380 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that the petitioner has committed no offence and has falsely been implicated in this case. The petitioner is not named in the FIR. The petitioner was not arrested at the spot. The petitioner is rotting in jail since 17.07.2016. However, similarly situated co-accused Pramod Kumar Sah has already been allowed bail by a coordinate Bench of this Court in Cr.Misc.No.774 of 2017 vide order dated 12.01.2017.

Patna High Court Cr.Misc. No.25047 of 2017 (2) dt.05-06-2017 Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Kasba P.S. Case No.63 of 2016.
