The petitioner seeks bail in Bagaha P.S. Case No. 385 of 2017 instituted for the offence under Section 395 of the Indian Penal Code.

Petitioner is not named in the written report. There is no recovery from his possession. No Test Identification Parade has been held. The name of petitioner has come on the basis of statement of spy.

Counsel for the petitioner submits that petitioner is in custody since 6.7.2018.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like
