This application, for grant of anticipatory bail, arises out of Araria Police Station Case No. 502 of 2018, disclosing offences under Sections 406/409/420/34 of the Indian Penal Code.
It is specific case of the petitioner that his case is identical with the cases of co-accused, Mukesh Kumar Singh and Mahendra Chudhary, who have been granted anticipatory bail by orders, dated 21.12.2018 and 19.12.2018, passed in Criminal Misc. Nos. 76748 of 2018 and 73013 of 2018, respectively.
This stand, taken on behalf of the petitioner, is not
Patna High Court Cr.Misc. No.76822 of 2018(2) dt.11-01-2019 2/2 being controverted by learned A.P.P. for the State. Considering the above, this application is allowed. Let the petitioner, Bimlendu Kumar @ Bimlendra Kumar, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria, in connection with Araria Police Station Case No. 502 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
