JUSTICE SHIVAJI PANDEY ORAL ORDER 01-07-2017 Heard learned counsel for the petitioners and learned counsel for the State.
In this case, the petitioners are seeking anticipatory bail in connection with Morkahi P.S. Case No.60 of 2015, registered for the offence punishable under Sections 420, 467, 468, 323, 379, 341 and 504/34 of the Indian Penal Code and under Section 27 of the Arms Act.
Allegation has been made against that fraudulently the vendor has sold the land excess to the share. Learned counsel for the petitioners submits that the petitioner no.1 is the purchaser whereas the petitioner nos. 2 and
Patna High Court Cr.Misc. No.24867 of 2017 (2) dt.01-07-2017 2/2 3 are the witnesses and they have wrongly been implicated in the present case. He further submits that basically it is civil dispute and cannot be a basis for putting the petitioners behind the bar. Looking to the nature of allegation and the facts and circumstances of the case, let the above named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Khagaria, in connection with Morkahi P.S. Case No.60 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
