ANJANA MISHRA ORAL ORDER 09-12-2019 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are apprehending their arrest in connection with Banshi P.S. Case No.16 of 2019 registered for the offence punishable under Sections 147, 149, 353, 427, 504 and 506 of the Indian Penal Code.

Learned counsel for the petitioners submits that the entire allegation is false and frivolous and there is omnibus and general allegation against the petitioners of having thrown bricks on the informant, but there is no reported injury. Considering the aforementioned facts and

Case No.15 of 2019 lodged on the same date and the same transaction of the occurrence under the similar provisions of the Excise Act, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Krishna Kumar Chaudhary, Additional Chief Judicial Magistrate-1, Arwal, in connection with Banshi P.S. Case No.16 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
