2. The petitioner is apprehending his arrest in connection with Bangra P.S. Case No. 52 of 2024, F.I.R. dated 15.04.2024 for the offences punishable under Sections 341, 323, 504, 506, 307, 354, 379 and 34 of the Indian Penal Code.

3. According to prosecution case, all the accused persons including this petitioner have assaulted the informant by means of lathi and rod and also wrap gamcha around his neck in

Patna High Court CR. MISC. No.75216 of 2024(4) dt.14-02-2025 2/3 order to kill him.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in the present case due to land dispute. Further submits that it appears from the FIR that there is specific allegation against the petitioner that he has assaulted to the informant and his wife. It is further submitted that the wife of the petitioner, namely, Amrita Devi has been granted privilege of anticipatory bail vide order dated 05.10.2024 in Cr. Misc. No.65599 of 2024.

Learned APP for the State, on the other hand vehemently opposed the prayer for anticipatory bail of the petitioner and submits that from the F.I.R. it appears that there is specific allegation against the petitioner that he has assaulted to the informant by means of back of the spade and the injury report also suggests that the injuries are grievous in nature caused by the hard and blunt substance. Learned APP for the State further submits that the co-accused has been granted bail on the ground that there is no specific allegation of assault against her.

6. Considering the aforesaid facts, I am not inclined to giving privilege of anticipatory bail to the petitioner in connection with Bangra P.S. Case No. 52 of 2024 pending in the

Patna High Court CR. MISC. No.75216 of 2024(4) dt.14-02-2025 3/3 court of learned Chief Judicial Magistrate, Samastipur.

7. Prayer is refused.
