The petitioner apprehends his arrest in connection with Bhojpur Mahila P.S. Case No. 103 of 2019, registered under Sections 376 and 511 of the Indian Penal Code and Section 6 of the POCSO Act.
The accusation is of committing rape of minor daughter of the informant, Rita Devi, by the petitioner, who is son of her brother-in-law.
Learned counsel for the petitioner submits that, admittedly, petitioner is son of brother-in-law of the informant and due to land dispute the present case has been lodged with false allegation. Moreover, in medical examination of the
Patna High Court CR. MISC. No.64372 of 2019(2) dt.24-10-2019 2/2 daughter of the informant, no any external or internal injury was found. Further submission is that petitioner has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Additional Sessions Judge-I, Bhojpur at Ara, in connection with Bhojpur Mahila P.S. Case No. 103 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
