The petitioner seeks bail in a case registered under Section 37(ii) of Bihar Prohibition & Excise Act, 2016 and Sections25(1-B)a/26 of the Arms Act. Allegedly, one country-made pistol without cartridge is recovered from possession of of the petitioner. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 04-04-2019. Charge sheet has already been submitted. One country-made pistol without cartridge is alleged to have been recovered. There is no compliance of Section 100 Cr.P.C.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Excise Act, Nawada in connection with Rajauli P.S.
