The petitioner has filed the instant application for grant of regular bail in connection with Akbarpur P.S. Case No. 504 of 2020 registered under sections 302 and 201 of the Indian Penal Code.

Prosecution case in short is that the daughter of the informant who had gone to Govindpur Ziwika office to bring honorarium of twelve months but, she did not return to her house. On the next day, her dead body was found near Patangi Mor.

Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.69790 of 2022(2) dt.28-02-2023 2/3 petitioner is innocent and has committed no offence. He has falsely been implicated in this case on the basis of suspicion. The petitioner is not named in F.I.R. rather his name came into light in this case on the basis of confessional statement of co-accused namely Pravin Kumar @ Pawan Kumar before the police which has no evidentiary value in the eyes of law. Except confessional statement of co-accused, nothing consistent material has come against the petitioner during investigation. He has no concern with the alleged occurrence. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent and he is languishing in judicial custody since 30.08.2022. Similarly situated other co-accused persons have already been granted bail by different co-ordinate Benches of this Court which are annexed as Annexure-2 and Annexure-3 of this petition. The application for bail is vehemently opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Akbarpur P.S. Case No. 504 of 2020 on

Patna High Court CR. MISC. No.69790 of 2022(2) dt.28-02-2023 3/3 furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Nawada.
