The petitioner seeks regular bail in connection with Warisaliganj P.S. Case No. 207 of 2018 for the offenses punishable under Sections 147, 148, 149, 341, 323, 307 and 302 of the Indian Penal Code and Section 27 of the Arms Act. It has been submitted by the learned counsel for the petitioner that there is no allegation of any specific overt act as far as the petitioner is concerned, the petitioner is having a clean antecedent and altogether 23 persons are named in the FIR and at best the petitioner herein can be said to be a member of the unlawful assembly. It is further submitted that similarly situated co-accused persons have already been granted bail by this Court vide order dated 10.09.2018 passed in Criminal Misc. No.

Patna High Court Cr.Misc. No.70484 of 2018(2) dt.12-12-2018 2/2 52518 of 2018.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Warisaliganj P.S. Case No. 207 of 2018.
