The petitioner seeks bail in a case registered for the offence punishable under Sections 363, 366 (A) of the Indian Penal Code.

Prosecution case is that as per FIR, the daughter of the informant aged about 14 years who had gone to tuition on 09.05.2019 is missing and this petitioner is said to have enticed her away. Thus, this case was lodged against the petitioner on 26.06.2019.

Learned counsel for the petitioner submits that the victim had gone to her Maushi house without informing her parents and has remained all the days. She came her house and thereafter this case was lodged. No persons had kidnapped her.

Patna High Court CR. MISC. No. 66904 of 2019(2) dt.06-11-2019 2/2 Such fact is apparent from the statement of the victim u/s 164 of Cr.P.C. The petitioner is in custody since 27.06.2019 and has got no criminal antecedent.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M.-1st Class, Masaurhi, in connection with Masaurhi P.S. Case No. 481 of 2019.
