Mr. Rajendra Nath Jha ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 13-12-2018 Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks regular bail in connection with Banmankhi P.S. Case No. 186 of 2018 for the offences punishable under Sections 489(B) and 489(C) of the Indian Penal Code.

The allegation is regarding the petitioner having exchanged counterfeit currency notes amounting to a sum of Rs.850/- with the genuine currency notes from the beggars. Subsequently, it transpired that the informant and other beggars had been duped by the petitioner herein. Accordingly, a written report was submitted by the informant with regard to the said incident.

No.72648 of 2018(2) dt.13-12-2018 2/2 The learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in the present case inasmuch as no recovery has been made from the person of the petitioner herein. It is further submitted that the petitioner is having a cosmetic shop at Footpath in the Mandir campus and has been falsely implicated in the present case at the instigation of the Secretary of the Mandir. The petitioner is stated to be having a clean antecedent and is languishing in custody since 17.09.2018.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned C.J.M., Purnea in connection with Banmankhi P.S. Case No. 186 of 2018.
