The petitioner apprehends his arrest in Sheikhpura P.S. Case No. 480/2008 (G.R. Case No. 1115/2008), registered for the offences punishable under Section 302 and 34 of the Indian Penal Code and section 27 of the Arms Act. The anticipatory bail application was earlier rejected by this court vide order dated 12.02.2018 passed in Cr. Misc. 54260/2017. From perusal of the aforesaid order, it appears that the same has been passed on merit after considering the facts of the case, therefore, this court is not inclined to entertain the second application. Same is dismissed.

The petitioner is directed to surrender in the court below within a period of four weeks from the date of receipt of

No.70543 of 2018(2) dt.12-12-2018 2/2 this order and make prayer for regular bail, learned court below shall consider the prayer for regular bail of the petitioner on its own merit without being prejudiced by this order and if possible his bail application may be disposed of on the same day.
