JUSTICE RAJIV ROY ORAL ORDER 28-06-2023 On call, no one appears on behalf of the petitioner although Mr. Ibadur Rehman, AC to AAG 12 is present. The present petition has been filed for issuance of an appropriate writ/order/directions commanding the Respondent/Authorities not to construct Panchayat Bhawan at Mauja Harchandpur Thana No. 164 Khata No. 356, Khesra No. 1351, as contained in Annexure 1 and 2 respectively rather to construct the said proposed Panchayat Bhawan at village Siyan,

Patna High Court CWJC No.21143 of 2019(3) dt.28-06-2023 2/3 since there is already a Panchayat Bawan existing in village Harchandpur of Gram Panchayat Siyan.

A counter affidavit has been filed on behalf of the Respondent Nos. 2, 3 and 5 and the learned assistant Counsel has taken this Court to paragraph 7 which read as follows:- "That it is submitted and stated that it is quite clear from the proposal dated 16.01.2023 sent by DCLR Kahalgaon Bhagalpur to District Panchayati Raj Officer, Bhagalpur that the details of the land selected for construction of Panchayat Sarkar Bhavan is as follows- Mauza- Siyan, Thana no. 311, Khata no. 368, Khosra no. 715, type of land- Parti, entered in the name of Anabad Bihar Sarkar, area 03 acres and 82 decimals out of which 50 decimals is being earmarked for construction of the said Panchayat Sarkar Bhavan. This is further confirmed proceedings of the meeting of the committee for selection of sites for construction of Panchayat Sarkar Bhavans held on 03.02.

2023, wherein at Serial No. 06, the proposal for construction of Panchayat Sarkar Bhavan at Mauza- Siyan, Thana no. 311, Khata no. 368, Khesra no. 715, entered in the name of Anabad Bihar Sarkar, Area 03 acres and 82 decimals out of which 50 decimals being transferred for said Panchayat Sarkar Bhavan has been unanimously approved by the said Committee."

In that view of the matter, the learned State Counsel

Patna High Court CWJC No.21143 of 2019(3) dt.28-06-2023 3/3 submits that the grievance of the petitioner has been redressed and the same have been incorporated in paragraph 7 of the counter affidavit. This Court accepts the version put forward by the learned State Counsel.

The writ petition accordingly stands disposed of. Before parting, this Court would like to put on record its word of appreciation for Mr. Ibadur Rehman, learned AC to AAG 12 for proper assistance in the matter.
