The petitioners apprehend their arrest in a case registered for the offence punishable u/s 126, 115(2), 352, 351(2-4), 77, 78, 109, 3(5) of BNS, 2023 and Section 27 of the Arms Act. 3.

Allegedly, all the FIR name accused persons along with the petitioner abused and physically assaulted the informant also filmed her half naked photo and also threatened her to make her photo viral. It is also alleged that they fired and threatened the informant to kill.

It is submitted by learned counsel for the petitioners that petitioners are quite innocent and have committed no offence. They have been falsely implicated in this case due to previous enmity and mala fide intention. No incriminating article has been

Patna High Court CR. MISC. No.77258 of 2024(2) dt.14-11-2024 2/2 recovered from conscious physical possession of the petitioners and no injury was caused from the firing. No such occurrence, in the manner as alleged, has ever taken place. Similarly situated coaccused person has been granted anticipatory bail by a co-ordinate Bench of the Court passed in Cr. Misc. No. 75943 of 2024 vide order dated 12.11.2024. Petitioner no. 1 has one criminal antecedent and petitioner no. 2 has no criminal antecedent as mentioned in para 3 of the bail application.

Learned APP for the State opposed the prayer for bail. 6.

Having regard to the facts and circumstances of the case, and since similarly situated co-accused person has been granted bail by a co-ordinate Bench of the Court, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Krishnagarh P.S. Case No.62 of 2024, subject to the conditions as laid down under Section 482(2) of the BNSS, 2023.
