Petitioner is languishing in judicial custody since 16.03.2017 in connection with Katoriya P.S. Case No. 20/2017, G.R. No. 570/2017 for offences punishable under Section 395 of the Indian Penal Code.
The prosecution case, as lodged by the informant, is that while he was returning in his Innova vehicle with his niece and servant, 8-10 miscreants stopped his vehicle and looted all his belongings and also the belongings and cash of his servant and driver and fled away in the forest.
It has been submitted by the learned counsel for the petitioner that he is innocent, not named in the First Information
Patna High Court Cr.Misc. No.25319 of 2017 (9) dt.03-11-2017 2/2 Report and at paragraph 3 of this application he has stated that he has no criminal antecedent.
In this connection, photo copy of the case diary was called for and from the case diary, it appears that there are four more cases pending against the petitioner.
Considering the facts and circumstances and due to concealment of his criminal antecedent, I am not inclined to grant privilege of bail to the petitioner in connection with Katoriya P.S. Case No. 20/2017, G.R. No. 570/2017, pending in the court of learned Chief Judicial Magistrate, Banka.
Application is, accordingly, rejected.
