The petitioner has prayed for regular bail in a case registered for the offence punishable under section 399, 402, 414 of the IPC and Section 25(1-B)a, 26/35 of the Arms Act. As per allegation in the FIR, on getting secret information, patrolling party proceeded towards place of occurrence and apprehended five accused persons and from their possession, one country made pistol and two live cartridges were recovered from the possession of the petitioner. Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case. The Alleged seizure list is manufactured by the police after taking the signature of the petitioner on blank paper. It is further submitted

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Pipra P.S. Case No. 171 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari.
