2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 420, 409 and 120B of the Indian Penal Code.

3. Allegedly, the petitioner is said to have misappropriated Rs.5,84,350/- of Government fund.

4. It is submitted by learned counsel for the petitioner vide order dated 24.02.2023, the petitioner was ready to deposit Rs.5,84,350/- as demanded against him. He further submits that the petitioner has deposited the entire amount in the concerned Department. Petitioner has one criminal antecedent.

5. Learned APP for the State as well as learned counsel

Patna High Court CR. MISC. No.69107 of 2022(4) dt.06-11-2023 2/2 for the BSFC opposed the prayer for anticipatory bail.

6. Having regard to the facts and circumstances of the case, the learned Court below is directed to confirm the provisional bail of the petitioner, after satisfying that the petitioner has deposited the entire amount as demanded against him in the concerned Department, in connection with Sonbarsa P.S. Case No.246 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
