2. The petitioner apprehends his arrest in connection with Shahpur P.S. Case No. 156/ 2024 dated 18.04.2024 registered for the offence(s) punishable under Section(s) 341, 342, 323, 307, 379, 504 and 506 read with section 34 of the IPC.

3. As per the prosecution's case, this petitioner in drunken condition assaulted the informant's uncle, Birendra Singh by means of Farsa repeatedly, as a result of which, he sustained injuries on his head and hand.

4. The main submissions advanced by learned counsel for the petitioner are that there is case and counter case in

No.72905 of 2024(3) dt.22-01-2025 2/3 between both the parties, who are co-villagers, in fact, an incident of free fight took place in between the parties in which both the sides sustained simple injuries and as per the prosecution story, the petitioner is alleged to have assaulted the informant's uncle, Birendra Singh, repeatedly on his head by means of Farsa but on his head, only one simple injury was found and the same has been opined to be simple in nature. It is further submitted that the petitioner has fair and clean antecedent and as per the petitioner's FIR, the petitioner was badly assaulted by one, namely, Deepak Singh, who is said to be an interested person to the prosecution party of this matter and in this regard, FIR of Shahpur P.S. Case No. 157 of 2024 is relevant of which copy has been filed with this petition.

5. Learned APP appearing for the State has opposed the bail prayer of the petitioner and submitted that the allegation levelled against the petitioner gets corroboration from the injury report of the informant's uncle, Birendra Singh.

Having considered the seriousness of the allegation relating to murderous attempt allegedly made by the petitioner on the injured, Birendra Singh, by inflicting injury on his head by means of Farsa, and the same gets corroboration from victim's injury report mentioned in the case diary, this court is
